Every year the Roman Rota deals with a few penal cases, maximum nine cases in a single year. The Rotal decisions on penal matters are evidently so few that it might even seem difficult to delineate a true jurisprudence, in the classic sense. However, the decisions handed down by the Rotal Judges are of increasing interest for the in-depth study of the issues at stake. Therefore, they are useful to the students, scholars as well as the staff of the Tribunals at all levels. This webinar deals with the notion of delict and its elements, along with the judgment on various delicts as seen in some important Rotal decisions.
Monsignor Michael Xavier Leo Arokiaraj
Monsignor Michael Xavier Leo Arokiaraj, born at Mettuppatti, India, was ordained a priest in 1984, after initial formation. After a few years of pastoral experience, he obtained a Bachelor of Civil Law, from Bharathidasan University, India (1985-1988) and later concluded his licentiate in canon law at Pontifical Urban University, Rome (1992-1994), and also his doctorate in canon law at the same University (1994-1996).
Immediately, he was called by the Holy See to join her Judicial Services (1996) and became a Rotal Advocate in 1998. Later he became the head of the Chancery of the Roman Rota (2000-2007) and on 25th April 2007, he was appointed a Judge of the Roman Rota. He has been a Professor of Jurisprudence, Rotal Law College (Roman Rota), from 2010-2013, and from 2013, a Professor of Praxis iudicialis, Rotal Law College. He is also a Commissioner for the Ratum et non consummatum cases (from 2013). On 27 August 2014, he was appointed by Pope Francis as a Member of the Special Commission for the Reform of Matrimonial Procedural Law.
